FAQDoes the skipper's liability insurance cover damage to the third-party yacht I am skippering?
In principle, skipper’s liability insurance covers damage caused by the skipper, as the policyholder, whilst operating a third-party yacht, and for which a third party makes a claim against him for compensation (for personal injury, property damage or financial loss) in accordance with statutory liability provisions. Damage to the yacht itself, which is being skippered by the skipper, is only covered in cases of gross negligence and subject to an excess of EUR 2,500, provided that compensation cannot be claimed under another insurance policy. You must therefore ensure that you have proof of comprehensive insurance for the yacht you are operating. The amount of the deposit to be paid should correspond to the excess under the charter company’s comprehensive insurance policy.
Are the crew members also insured?
Yes, crew members are covered under the skipper’s liability insurance.
Are damage claims covered?
No, the charter company’s retention of the deposit is not covered by the skipper’s liability insurance. To cover the deposit, separate deposit insurance should be taken out.
What cover is available if the yacht I am skippering is not covered by third-party liability insurance?
If the yacht is not covered by third-party liability insurance, the skipper’s liability insurance will assess any claims made in the event of a claim. In the event of an incident covered under the terms and conditions, the skipper’s liability insurance will apply.
What cover is provided if the yacht is already covered by third-party liability insurance?
If the yacht is covered by third-party liability insurance, all claims must first be reported to the yacht’s own insurer. In this case, the skipper’s liability insurance provides only supplementary cover.
What does ‘subsidiary cover’ mean in the context of skipper’s liability insurance?
Claims under the terms and conditions and sums insured of the skipper’s liability insurance may only be made insofar as they cannot already be claimed under another insurance policy.
When do I need commercial skipper liability insurance?
You must take out commercial skipper’s liability insurance if you receive any commercial benefit, remuneration or other financial advantage from your work as a skipper. If you are acting as a skipper on a private club sailing trip as a member of a sailing club, and your crew (fellow club members sailing with you) merely cover your costs for, for example, flights, food and accommodation, Pantaenius does not regard this as a financial benefit, meaning that cover would already be provided under the skipper liability insurance for private use. This also applies at Pantaenius if you act as a skipper on a private sailing trip with friends and your fellow sailors merely cover your costs accordingly.
